The competence of the Joint Committee for Transport and Logistics is defined in a Royal Decree of 7 May 2007, published in the Belgian Official Gazette of 31 May 2007.

A Royal Decree of 6 September 2012 (B.S. 09/10/2012) establishes a Joint Subcommittee for Relocation.

The following is a description of the competence of the Joint Subcommittee on Relocation (140.05) and some practical arrangements.

A. Competence of the Joint Committee for Transport and Logistics (JC 140)

B. Joint Subcommittee on Relocation (140.05)

The Joint Committee for Transport was unofficially subdivided into various subsectors, including 'removal companies, furniture storage and related activities' (140.05). As from 19 October 2012, by Royal Decree of 6 September 2012 amending the Royal Decree of 22 January 2010 establishing the Joint Subcommittees for Transport and Logistics and laying down their names and powers, an official Joint Committee for Removals has been established.

The Joint Subcommittee for Removals is competent for the workers who mainly perform manual work and their employers, namely for undertakings which perform removal activities on behalf of third parties.

For the account of third parties shall mean: performing removal activities for other natural or legal persons, and provided that the companies performing removal activities on behalf of third parties do not at any time become the owners of the goods concerned.

Removal activities are understood to meanAny movement of goods other than commercial goods intended for or used for the furniture, fittings or equipment of private or professional premises, including, inter alia: specific operations such as protecting, packing, unpacking, dismantling, loading, unloading, assembling, storing, installing or assembling, if necessary by means of lifting or handling equipment of any kind.

The Joint Subcommittee on Removals shall not be competent in respect of undertakings performing removal activities which fall within the competence of the Joint Committee on Metals, Machinery and Electricity, the Joint Committee on Construction, the Joint Committee on Upholstery and Woodworking, the Joint Committee on Sectors Related to Metals, Machinery and Electricity, and the Joint Committee on Security and/or Surveillance Services.

C. Practical arrangements

The above text should enable you to check whether the Joint Committee for Transport and Logistics is competent for your company and whether you are covered by the Joint Subcommittee for Relocation. We repeat that the Joint Committee is only competent for your workers.

Employers belonging to the Joint Subcommittee for Relocation have a registration number with the NSSO, preceded by the code number 084.
